Apple Challenges Aussie Retailer Woolworths’ New Logo (Apple Computer – Litigious To The Core?)

When I saw the new logo used by Australian supermarket chain Woolworths I immediately thought: smart, smart move. The retailer is responding to the general community mood by embracing the ‘green’ theme, and evincing a fresh new look with a stylized ‘W’ that looks a little like an lettuce… or maybe an apple.

Actually, Apple Computer reckons Woolworths’ logo looks a LOT like an apple and, in particular, a lot like Apple’s logo. What rot! Here are the two logos – do they look confusingly similar to you?

Apple Computer is certainly baring its litigious core by challenging Woolworths’ attempt to register a trade mark for its new logo. To be fair, Apple is likely concerned that Woolworths is attempting to apply its trade mark to every conceivable good and service – including electronic goods.

That’s understandable since Woolworths is increasingly selling all kinds of goods and services in its stores and wrapping its own brand on more and more of those goods and services.

But take another look at the two logos – are they really alike? Is there really any likelihood of confusion? Ultimately, that’s for IP Australia – the Australian body that approves trade mark, patent and design registrations – to decide. But, for what it’s worth, I think there is NO likelihood of confusion and nothing but a vague similarity between the two logos. And, for goodness sake, can’t anyone other than Apple Computer use an apple in their logo?

Let’s hope IP Australia sees the sense in all this. Even better, let’s hope Apple Computer sees sense and drops its case. Sure, the computer company apparently has a lot of spare cash to spend these days (due to its incredible success with its iPod, iPhones and iTunes offerings), but does the company really want to waste it on litigation? What about continuing to invest in more innovative products and product enhancements?

Come on Apple, ripen up.
