Anti-Spam Laws Unconstitutional

The Virginia Supreme Court has declared Virginia’s anti-spam law unconstitutional and overturned the conviction of infamous spammer, Jeremy Jaynes.

The court unanimously held that the Virginian law violates the protect of free speech under the First Amendment of the United States Constitution. This is because the law restricts ALL kinds of unsolicited emails, not just commercial messages.

Commercial spam is still illegal in Virginia under the Federal CAN-SPAM Act.
